Terms & Conditions of Entry


AGB Events Pty Ltd (AGB) is the creator and producer of ELEVATE SYDNEY 2022 (Event).  As the responsible party for the event activities, site operations, and general conduct at the Event location (Venue), AGB requires that all visitors (you/your) comply with the full Terms and Conditions below.

For extra visibility, here are the top 5 reminders:

1. Visitors must comply with all ELEVATE Sydney COVID Safety guidelines, including

(a) At entry, completing contact registration via QR code and demonstrating double vaccination against COVID-19.

(b) While on site maintaining social distancing between groups and if required wearing masks for additional protection.

2. Visitors cannot bring any restricted items on site.

3. Visitors cannot sell or distribute any items or materials.

4. Visitors cannot impede other visitors’ view or enjoyment of the event.

5. Visitors must follow all instructions of Venue Management.


By entering this site all visitors agree to these Terms.  Furthermore you (and your group) acknowledge your personal responsibility for safeguarding against COVID risks, which begins with staying home if unwell.  When on-site you commit to following COVID safety guidelines of event organisers and NSW Ministry of Health.

Refusal of Entry

1. For the comfort, safety and enjoyment of all patrons, AGB reserves the right to refuse entry to the Venue of a person or item in the following circumstances:

(a) appropriate entry protocols have not been followed, including registration, adherence to health questions, or other checks intended to ensure public safety

(b) persons are, or are considered on reasonable grounds by AGB or their respective agents or contractors, to be intoxicated, under the influence of drugs or disorderly or the presence of the person would be detrimental to, or compromise safety at, the Event;

(c) persons wearing or displaying commercial, political or other offensive signage or logos (except for official merchandise or other Event related clothing worn in good faith);

(d) persons who refuse to submit themselves or their belongings for inspection;

(e) items which have the potential to cause injury or public nuisance, including Restricted and Prohibited items listed in clause 7; and

(f) due to adverse weather, dangerous situations or any other causes that may affect the safety of patrons.

General Conditions of Entry

2. The following applies as a condition of entry into the Venue:

(a) AGB reserve the right to inspect and search bags brought into or out of the Venue;

(b) Persons 13 years and under must be at all times under the direct supervision of a parent or legal guardian who has complied with all entry requirements;

(c)You must not enter any of the Venue’s restricted areas, such as back of house, performance areas, or any other area not accessible by the public;

(d)Narcotics (other than those prescribed by a registered medical practitioner) must not be taken into the Venue;

(e) Alcoholic beverages must not be taken into the Venue;

(f) Food and beverage deliveries and product from external caterers and commercials outlets are not permitted in the Venue;

(g) Patrons are not permitted to bring food and beverage into the Venue with the following general exemptions, subject to Venue Management approval:

  • One bottle or thermos per person, which may be checked for liquor licensing purposes
  • Infant food and beverage and light snacks for personal consumption, provided they are packed appropriately and can be viewed by Staff or Security Personnel if requested
  • Approval on whether any food and beverage products will be permitted are at the discretion of Venue Management.

(h) Smoking (including the use of electronic cigarettes or similar devices) is prohibited;

(i) Unauthorised soliciting, collections and customer surveying is not permitted.

(j) You must not engage in any form of ambush marketing and must not conduct any activity that conflicts with, impairs, infringes or denigrates the rights of any official sponsor, the Venue or AGB.

Eviction from Venue

4. AGB reserves the right to eject from a Venue any patron who in its sole opinion:

(a) breaches any General Condition of Entry;

(b) does not, upon request demonstrate compliance with entry requirements;

(c) is in breach of any of these Terms;

(d) unreasonably obstructs the viewing of other patrons;

(e) may be a source of danger, nuisance, or annoyance or otherwise give rise to concerns in relation to the safety and security arrangements for an Event, including excessive noise, use of foul, obscene, abusive or racist language or gestures, the wearing or other display of commercial, political or offensive signage or logos, or the throwing of any object that might injure or cause damage to people or property;

(f) fails to comply with instructions from AGB, police, or security officer;

(g) is in possession of any item listed on the Restricted and Prohibited listed in clause 5;

(h) is suspected of committing, or being likely to commit, or having committed a criminal offence within the Venue;

(i) enters any area at the Venue which he/she is or may be prohibited from entering;

(j) damages, interferes with or tampers with any AGB or Venue property; or

(k) refuses to comply with requests made by AGB;

(l) Refuses any requests made by AGB in relation to the Event COVID-19 Management Plan.

Restricted and Prohibited Items

5. The following restricted and prohibited items are not permitted into a Venue:

  • Illegal substances, including controlled, dangerous or illicit drugs
  • Alcohol and glass – of any kind
  • Laser pointers, spotlights, flares or fireworks
  • Weapons, or resemblance of weapons, including knives, firearms, blunt offensive objects, batons, selfie sticks, umbrellas and those with sharp ends
  • Projectile items, including balls, frisbees, rackets or similar objects
  • Political or offensive materials
  • Drones or loud hailers without the prior consent of AGB
  • Animals (only Guide Dogs permitted)
  • Seats, crates or camping chairs
  • Prams and strollers will not be permitted in the event area. There will be pram parking available free of charge at the entrance to ELEVATE Sydney and monitored by staff during the day. However, items will be left at own risk and ELEVATE Sydney will not take any responsibility for misplaced property. We recommend attending the event without your pram if you are able.
  • Other items as determined by AGB that may cause injury, public nuisance, or safety concerns.
Patron Safety and Behaviour

6. You must comply with the directions or announcements from AGB and any other requirements relating to access and safety given by AGB or authorities.

7. You must maintain safe, prudent and respectful behaviour at all times. A patron is responsible for his or her own conduct whilst in a Venue for an Event and must pay for the cost of repair of any damage caused to a Venue as a result of their conduct.

8. You must not enter the designated performance areas of a Venue at any time and, if you do, you may be fined, expelled from that Venue and subject to legal action.

9. You must remain appropriately clothed while in the Venue.

10. The following actions are restricted in the Venue:

  • Riding of Bicycles, skateboards, skates and scooters
  • Impeding other visitors’ view of the event with items that may block visibility or hinder enjoyment, including flags, banners or flags, musical instruments, drums, whistles, air horns, or other noise makers
  • Having animals off leash (other than trained assistance dogs)
  • Other actions as determined by AGB that may cause injury, public nuisance or safety concerns.
Liability and Risk

11. Patrons wishing to bring personal items into Venue do so at their own risk. AGB will not be held responsible for any damage to, loss or theft of, your personal property.

12. AGB does not guarantee that you will have an uninterrupted and/or uninhibited view of the Event from your location within the Venue, nor does AGB give any warranty as to the quality, content or duration of the Event.

13. There are risks and inherent dangers associated with attending Events and associated activities that may result in patrons being injured. To the extent permitted by law, you agree not to bring any claim or proceeding against AGB for any damage, loss, injury or liability you may suffer in accessing the Venue or attending the Event.

14. Patrons attending the Event do so at their own risk and assume all risk and liability for personal injury or death, including that of any minors in their care. AGB bears no liability for any personal injuries, health problems or death sustained at or after the Event, including directly or indirectly resulting from any existing medical condition. AGB takes no responsibility for any hearing damage or loss. Use earplugs if necessary.

Photographs and Broadcasts

15. Photographs taken within the Venue are encouraged but may be used only for private non-commercial purposes. For the avoidance of doubt, commercial purposes include licensing, merchandising, memorabilia, or marketing.

16. Patrons are not permitted to transmit, broadcast, sell, license or otherwise publish, disseminate or reproduce any recordings (including photographic, video or sound recordings) of the Event without AGB’s prior written approval.

17. If you make, reproduce or use any recording, data or image prohibited under this condition, you must assign in writing all copyright and intellectual property rights to AGB or its nominee.

18. With or without your knowledge, you may be recorded on CCTV or other forms of surveillance in, or in the vicinity of, the Venue, filmed or photographed individually or in a crowd scene by any person and your voice recorded at an Event (or any one or more of these things). You irrevocably and unconditionally consent in perpetuity and without compensation to the recording, filming, photographing, transmission and use (or any one or more of these things) by AGB and its nominees (or either) of your likeness and voice (or either) by any means (including, audio and visual recordings by television cameras and photographers) throughout the world, to the fullest extent possible, including for official broadcast and promotional purposes (or either).

Event Changes and Cancellation

19. AGB may add, withdraw, reschedule or substitute performance elements (as applicable) or vary advertised programmes, times, Venue, seating arrangement or audience capacity without any compensation to you.

20. AGB may postpone, cancel, interrupt or stop the Event, or deny access to the Venue, due to adverse weather, dangerous situations or any other causes without any compensation to you.

21. AGB is not liable to you for any loss or damage you suffer as a result the Event being cancelled, postponed or changed. AGB disclaims the existence of any common law duty of care to you.

Privacy Statement

22. AGB respects the privacy of the individuals on whom AGB collects, uses and discloses personal information. The personal information that AGB collects will be in accordance with practices as reasonably required for the proper and efficient staging of Events and to give effect to any of its rights under these Terms.

23. You may request access to personal information AGB holds about you by sending an email to [email protected]


24. AGB may choose not to enforce a clause of these Terms in some cases in its absolute discretion without affecting its right to enforce that term in other cases.

25. These Terms are governed by the law applicable in New South Wales and each party irrevocably and unconditionally submits to the exclusive jurisdiction of the courts of New South Wales.


26. AGB reserves the right to update, modify or change these Terms from time to time. Any changes will be available on AGB’s website.


27. Ensuring the health and safety of the community is our top priority, and patrons will be denied entry to the Venue should they have symptoms that may place persons at risk or endanger or impact on public health.

28. By entering an AGB Event, you and your guest(s) acknowledge that, even with rigorous control measures in place at the Venue, there remains at this time, an unquantifiable risk of transmission of viral illness including COVID-19. By attending the Venue you and your guest(s) acknowledge that you have considered those risks and your personal circumstances, including any health condition or vulnerability that you or your guest(s) may have, and the circumstances of persons with whom you will be in close contact following your attendance at the Venue. You acknowledge that, for a small number of people, COVID-19 has very serious health consequences.  AGB expressly relies on you to bring this health issue waiver to the attention of your guest(s). AGB will rely on this health issue waiver and proceed on the basis that you and your guest(s) acknowledge and accept these risks.

29. The primary registrant agrees to be the primary contact in the Event of any contact tracing required, and you will be responsible for knowing the contact details of all attendees in your group. In the Event that the Ministry of Health, or another Government Department, makes a formal request, we may be required to disclose your contact information for contact tracing purposes, including your full name, contact email and/or contact phone number.

30. AGB strongly recommends that you and your guest(s) use the additional COVID-19 resources available on the Service NSW application on on your mobile phone.

31. Venue Patrons are expected to follow any requests in regard to COVID-19 including maintaining physical distancing requirements and Venue instruction relating to COVID-19.

32. Any requests relating to COVID-19 that are not adhered to with be treated as non-compliance with Venue requirements and subject to eviction from the Venue.
